What does Panama's Law 81 on data protection require?
It requires prior, free and informed consent before collecting personal data; using it only for the declared purpose; letting the data subject access, correct, delete, object to or port their data; applying security measures proportionate to the risk; being answerable for suppliers who process data on your behalf; and publishing a privacy notice. It has been in force since 29 March 2021 and is regulated by Executive Decree 285 of 2021.
Does my company have to comply with data protection?
Yes. Law 81 sets no threshold for size or turnover: it applies to any individual or company processing personal data on Panamanian territory. If you have a contact form, a customer list in a spreadsheet, a booking system, a payroll or cameras recording identifiable people, you are within scope.
What are the fines for breaching Law 81 in Panama?
Between one thousand and ten thousand balboas depending on severity and repeat offences, plus a written warning, closure of records, suspension of processing activities and any damages claimed by the affected person. ANTAI enforces it, and proceedings usually start from a complaint by a customer or a former employee rather than a routine inspection.
How do I protect my company's data?
The order that removes the most risk for the least effort is: inventory where personal data lives, lock down who accesses what — because usually half the company has access to everything — turn on two-step verification for email and critical systems, have backups that are tested rather than merely configured, and write down what to do if something leaks. Expensive tools without those five steps deliver very little.
How do I protect my company from ransomware?
The defence that actually decides the outcome is backup: offline or immutable copies, tested by genuinely restoring them, because a backup that has never been restored is an assumption. On top of that, limit administrator privileges, keep systems updated, turn on two-step verification and train the team, since the most common way in is still an email somebody opened.
